By using the services of WANALOHA (hereinafter "the Site"), you agree that you have read and understood these Terms of Service and agree to be bound by them. If you do not agree to any of these Terms of Service, please note that you will not be able to use the services of the Site.

Article 1 Relationship Between You and the Site
  1. These Terms of Service apply to transactions between you and the Site relating to travel plans, transportation services, tickets, and other tourism experiences (collectively, "Tourism Services") provided through the Site or other suppliers (each, a "Supplier") via the reservation system on the Site (the "Platform") (such services provided through the Platform being referred to as the "Service").
  2. These Terms of Service constitute the agreement between you and the Site regarding use of the Service (the "Service Use Agreement"). When using any part of the Service, you agree to be bound by these Terms of Service, the Site's Privacy Policy, and any other terms and conditions applicable to such service that the Site establishes on the Platform or offline. All of these terms and conditions constitute part of the Service Use Agreement (these Terms of Service and such other terms and conditions are collectively referred to as "these Terms").
  3. The Site may amend or update these Terms of Service at any time without prior notice to you, as required by applicable law or as the Site deems necessary, in accordance with Article 548-4 of the Civil Code. If these Terms of Service are changed, the latest version will be posted on the Platform (wanaloha.rezio.shop), together with the date on which the Terms of Service were last updated. By continuing to use the Service after the Terms of Service have been updated, you will be deemed to have agreed to the updated Terms of Service. Please check the latest Terms of Service when using the Service.

Article 2 Content of the Service
  1. Through the Service, you can easily and simply select and book/purchase Tourism Services provided by the Site or Suppliers via the Platform. You may only book/purchase Tourism Services through the Service for your own personal use or participation, and may not use the Service for the purpose of resale to third parties or any other commercial purpose.
  2. When your booking/purchase of a Tourism Service through the Service is confirmed, an agreement regarding the use of such Tourism Service will be formed between you and the Site, or between you and the Supplier, in accordance with the display on the Platform.
  3. The Site will endeavor to operate and maintain the Service and the Platform, but does not guarantee that the Service and the Platform will always function properly or will not be interrupted due to external factors. You agree that the Site has the right to refuse your access to the Platform or use of the Service, and has the right to change, suspend, discontinue, or terminate the Service or the Platform.

Article 3 Platform Content
  1. In these Terms of Service, "Platform Content" means all materials (including, without limitation, text, photographs, graphics, images, illustrations, video, audio, data, and code) posted or used by the Site on the Platform. You acknowledge that all Platform Content is owned by the Site or by licensors who license the Site to use such materials (collectively, "the Site, etc."), and is protected by applicable intellectual property laws. The Site may change, modify, or delete Platform Content without notice to you.
  2. Subject to your compliance with these Terms, the Site agrees to grant you a limited, non-exclusive, non-transferable license to use and access the Platform, and may revoke such license at any time without prior notice to you. You agree to comply with applicable intellectual property laws and other applicable laws, and to use and access the Platform Content only for personal, non-commercial purposes. Under no circumstances will you use, reproduce, translate, transmit, broadcast, sell, or transfer Platform Content, or create derivative works based on Platform Content, in any manner that would cause damage to the Site, etc. You agree not to bulk copy, store, or download Platform Content in any format. Furthermore, you agree to be responsible for all risks (including damages to the Site, etc.) arising from your use of or access to Platform Content. To the maximum extent permitted by law, the Site bears no responsibility whatsoever for Platform Content, including, without limitation, any errors or deficiencies in the Platform Content. You alone are responsible for any losses or damages suffered by third parties as a result of your use of or access to Platform Content.
  3. You acknowledge and agree that, in the course of using or accessing Platform Content, the Site may become aware of third parties with whom you interact, and that the Site cannot predict or control the conduct of such third parties. Accordingly, the Site cannot guarantee the reliability or accuracy of any content, materials, or information provided to you by other third parties through the Platform.

Article 4 Handling of Information Provided by You
  1. You agree that the Site may use your personal information in accordance with the Site's Privacy Policy.
  2. In order to collect your feedback and improve the Service and the Tourism Services, the Site may ask you, via SMS, email, or the Platform, to review a Tourism Service, but whether or not to submit a review is entirely at your own discretion. If the Site receives your review, the Site may upload it to the relevant page of the Platform and share and publish your satisfaction and comments (although the Site is under no obligation to share or publish it). In any review you provide, you must not use misleading, inappropriate, defamatory, threatening, abusive, or otherwise offensive language, and must not include your own or a third party's personal information, information unrelated to the Tourism Service you actually used, or content that violates any law or these Terms.
  3. You understand and agree that, regardless of whether your review (including, without limitation, text, photographs, images, and video) satisfies all elements of copyright under applicable intellectual property law, the Site, Suppliers, the company that provides the Platform to the Site (the "Platform Provider"), or users of the Platform may use such review. Accordingly, by providing a review to the Site, you irrevocably agree to the following:
    (a) You grant the Site, Suppliers, or the Platform Provider a non-exclusive, royalty-free, perpetual, worldwide, and sublicensable right to reproduce, modify, quote, revise, translate, create derivative works from, or otherwise use such review (including, without limitation, for advertising in any media).
    (b) You grant users of the Platform a non-exclusive right to access, use, reproduce, create derivative works from, or otherwise reasonably use such review through the Platform for non-commercial purposes.
    However, such permission granted by you does not affect ownership of the information you provide, unless you separately agree otherwise in writing.
  4. You warrant that all information you provide (including, without limitation, text, photographs, graphics, and video) does not violate any applicable law, does not infringe any third party's rights, does not violate these Terms, and that the use of such information by the Site, Suppliers, the Platform Provider, and users of the Platform will not infringe any third party's rights. You acknowledge that you bear sole responsibility for all information you provide, and that the Site bears no responsibility for any errors or deficiencies in the information you provide.
  5. The Site may, at its sole discretion, remove from the Platform any review or other information you have provided to the Site, and you agree to this without objection.

Article 5 Your Covenants
  1. You shall use the Service, the Platform, and the Tourism Services in full compliance with these Terms. You shall be solely responsible for all of your actions in using the Service, the Platform, and the Tourism Services.
  2. You covenant to comply with each of the following:
    (a) You must not copy, reproduce, distribute, publish, disclose, perform, transmit, or broadcast any part of the Service without the Site's prior written consent. This includes, without limitation, the following actions taken without the Site's express prior written consent:
      (i) Modifying, altering, disabling, or otherwise circumventing software that is permitted for use in using the Service.
      (ii) Using Platform Content for your own benefit or that of a third party.
    (b) You must not circumvent, damage, or interfere with any security or information management features of the Service, or access or use the Service in a manner other than its intended use.
    (c) Except to the extent permitted by these Terms or applicable law, you must not decompile, reverse engineer, disassemble, or hack, or request, authorize, or attempt any of the foregoing with respect to the Service or the Platform (including services available through them), or use or attempt to access any part of the Service or the Platform in any manner other than as intended by the Site.
    (d) Except where the Site makes available a means to incorporate the Service or part of its content, you must not use, display, mirror, or frame the Service (including content available through the Service or any part thereof) through another application or website, or use framing techniques to disclose it.
    (e) You must not access, tamper with, or use any non-public areas of the Service, the computer systems and infrastructure of the Site (and any company that provides hosting services to the Site), or the technical delivery systems of the Site's providers.
    (f) You must not harass, abuse, or harm the Site, the Platform Provider, the officers and employees of Suppliers, or other third parties, including other users of the Platform, or encourage or support such conduct by others.
    (g) You must not, in any manner, provide false personal information to the Site or a Supplier, create or provide false identification information, or impersonate a third party.
    (h) You must not solicit or attempt to solicit personal information from other users of the Platform.
    (i) You must not restrict, prevent, or prohibit any third party from using the Service, disclose personal information about a third party obtained through the Service without that third party's consent, or collect information about other users of the Platform.
    (j) Except as expressly permitted under these Terms of Service, you must not use the Service to advertise or promote commercial solicitations.
    (k) You must not engage in fraud, breach the information security of the Platform, decrypt other users' passwords, unlawfully transfer or store data, or engage in any other unlawful conduct.

Article 6 Order Confirmation and Refund Policy
  1. You may select and book/order, in the applicable currency, Tourism Services provided by the Site or Suppliers through the Platform. Except for bookings/orders that are expressly stated to be confirmed at the time of booking/ordering, other bookings/orders will require subsequent confirmation of availability by the Site or the Supplier. You agree to receive notification of the confirmation result by SMS, email, or mobile application. You also acknowledge that any time shown on the Platform for a reply regarding the result of your booking/order is provided for reference only, and does not constitute a promise to notify you of the result within that time. You further acknowledge that the time required to confirm your booking/order may be adjusted depending on actual circumstances.
  2. The Site has the right to change or adjust, at any time, the prices and fees for Tourism Services provided by the Site or Suppliers. Such changes may be displayed on the Platform, or notified via SMS, email, website, or mobile application. If you use the Service after notice of such a change, you will be deemed to have agreed to and accepted the changed prices and fees. However, for a Tourism Service whose booking/order was confirmed before notice of the change, the previous price and fee will apply.
  3. If you violate any of these Terms, the Site may refuse or cancel your booking/order for a Tourism Service without any prior notice.
  4. You agree to pay the Site for the Tourism Service fees using the payment method designated by the Site. You acknowledge and agree that the Site is under no obligation to provide the Tourism Service to you until payment has been completed in accordance with the Site's designated payment procedures. Unless otherwise specified in these Terms, prices and fees you have paid for a Tourism Service are non-refundable.
  5. If a Tourism Service you booked/ordered is provided not by the Site but by a Supplier, the Supplier may, at its discretion, accept or decline your booking/order, and if accepted, an agreement regarding use of the Tourism Service will be formed between you and the Supplier in accordance with Article 2, Paragraph 2. In this case, only the Supplier — not the Site — is responsible for providing the Tourism Service to you. If you have questions about the content of a service from a Supplier, contacting the Supplier directly is usually the most efficient way to get information, but if you contact the Site, the Site will attempt to contact the Supplier to help find a solution.
  6. You acknowledge and agree that additional taxes, fees, or charges may apply to certain Tourism Services provided by Suppliers depending on actual circumstances, and that you may be obligated to pay such amounts directly to the Supplier or the tax authority. The Site requires Suppliers to provide up-to-date and accurate terms of use, restrictions, prices, and other information regarding the services they provide, but the Site cannot guarantee that all content posted by Suppliers on the Platform is always accurate. If your booking/order is cancelled by the Supplier, the Site will notify you as promptly as reasonably possible.
  7. If you complete the cancellation procedure in accordance with the cancellation policy displayed on the Platform at the time of booking/ordering, or if the Site or the Supplier cancels because the conditions for the Tourism Service to proceed or other conditions of provision were not met, the amount you paid will be refunded to you using the same payment method used for the original payment. You acknowledge and agree that the refund amount you receive may differ from the amount you originally paid due to exchange rates or administrative or service fees charged by the credit card company or payment processor.
  8. Use of E-Vouchers
    (1) When you select and book/order a Tourism Service through the Platform, after the booking/order is confirmed, the Site will issue (except where a physical voucher is provided, etc.) an electronic voucher (an "E-Voucher") displaying your booking/order number and the Tourism Service you purchased, which you will receive by SMS or email. When using a Tourism Service, you must print the E-Voucher and bring it to the location where the Tourism Service is provided.
    (2) You agree to comply with the terms of use for E-Vouchers established by the Site and Suppliers. This includes, among other things, your personal appearance, on time, at the location designated by the Site or the Supplier, within the period of use stated on the E-Voucher, and presenting any documents or materials required by the Site or the Supplier (such as your photo identification, order/booking number, or E-Voucher). If you are unable to comply with the terms of use of the E-Voucher, you will not be able to receive the Tourism Service stated on the E-Voucher, and in this case, no refund will be given.
    (3) You acknowledge and agree that, even if your E-Voucher or booking/order number is lost or stolen, the Site or Supplier is under no obligation to reissue the E-Voucher or to provide the Tourism Service described in the E-Voucher. In addition, if you attempt to use an E-Voucher in violation of its terms of use, these Terms, or applicable law, the Site or Supplier may refuse to provide the Tourism Service, in which case no refund will be given.

Article 7 Limitation of Liability
  1. You understand that Platform Content may be provided by Suppliers or other third parties, and agree that the Site makes no representation or warranty regarding the accuracy of Platform Content. You agree not to hold the Site responsible for Platform Content provided by Suppliers or other third parties.
  2. You agree that content you communicate or transmit through the Platform may be improperly viewed or intercepted by third parties. You acknowledge that the Site bears no obligation or liability whatsoever to you regarding information security on the Platform.
  3. The Site, Suppliers, their officers and employees, and their agents shall bear no liability whatsoever for any damages arising from your failure to comply with these Terms, your use of the Service, the Platform, or the Tourism Services, or any other conduct of yours. However, this shall not apply where such damages arise from the Site's willful misconduct or gross negligence.
  4. To the maximum extent permitted by law, you agree that your sole remedy if you are dissatisfied with the Service is to stop using the Service. In any case where the Site is liable to you for damages, the maximum amount of such liability shall be the total amount you paid to the Site and Suppliers during the twelve (12) months immediately preceding the date of your claim.

Article 8 Indemnification
  1. If, as a result of your failure to comply with these Terms, or your use of the Service, the Platform, or the Tourism Services, a third party's intellectual property rights or other rights or interests are infringed and a dispute arises with such third party, you shall resolve the dispute at your own responsibility and expense. If the Site, Suppliers, their officers and employees, or their agents suffer damages (including, without limitation, litigation costs, attorneys' fees, and settlement costs) as a result of such dispute, you shall indemnify them for such damages.
  2. With respect to a dispute with a third party as set forth in the preceding paragraph, the Site may require you to defend against claims from such third party, take legal action, or engage in settlement negotiations, and you shall report the status of the dispute with such third party to the Site upon request. In addition, you may not take any action that could be detrimental to the Site's interests without the Site's prior written consent.

Article 9 Termination
If you violate any provision of these Terms, or if the Site determines at its sole discretion that it is necessary to do so, the Site may suspend your use of the Service and the Platform without prior notice to you, and may deactivate your account.

Article 10 Visas and Insurance
  1. Regardless of your nationality or destination, you are responsible for checking the entry requirements in effect at the time for your destination. Visa and health requirements for each country may change without notice, so we recommend that you check the latest entry requirements before departure.
  2. For your own rights and interests, depending on the content of the Tourism Services you use, we recommend that you obtain comprehensive travel insurance before departure.

Article 11 Dispute Resolution
These Terms and the relationship between you and the Site shall be governed by the laws of the jurisdiction in which the Site's place of business is located. You agree that the court of first instance having jurisdiction over the location of the Site's place of business shall have exclusive jurisdiction over disputes arising from your use of the Service, the Platform, and the Tourism Services.

Article 12 Miscellaneous
  1. If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain unaffected.
  2. The Site may assign its rights and obligations under these Terms, and may have a third party assume its obligations under these Terms. You may not directly or indirectly assign your rights and obligations under these Terms to a third party without the Site's prior written consent.
